Rights commission expects abolition of death sentence

Head of Indonesia’s National Commission on Human Rights (Komnas HAM) Atnike Nova Sigiro expects that death sentence in Indonesia can be abolished in the future.

“Komnas HM recorded within the new Criminal Code (KUHP) that death sentence no longer becomes the core criminal punishment and expects that death sentence can be abolished in the future,” she said in a statement, Monday (February 13).

Sigiro made the remark in response to the death sentence imposed by the South Jakarta District Court on the defendant –Ferby Sambo– in the case of premeditated murder of Brigadier Yosua Hutabarat.

She noted that while the right to life is included within non-derogable rights, death sentence is still implemented under the Indonesian law.

Nonetheless, the commission respects the legal process and decision taken by the judge and deemed that no single person is above the law.

“The crime committed by the defendant Ferdy Sambo is a serious crime,” she stated.

According to the judge’s decision, in addition to being proven to have committed a premeditated murder of his own subordinate, the defendant has also committed obstruction of justice.

“Moreover, he committed it using his authority as a law enforcement figure,” she said, referring to Sambo’s role in the murder.

Lastly, in response to the court’s decision, the commission expressed its condolences to the family of the slain brigadier.

At a trial session here on Monday, Chief Judge Wahyu Iman Santoso said that Sambo has been proven to have violated Article 340, subsidiary Article 338 in conjunction with Article 55, Paragraph (1) Number 1 of the Criminal Code.

Sambo also violated Article 49 in conjunction with Article 33 of Law No. 19 of 2016 on Changes to Law No. 11 of 2008 on Electronic Information and Transaction, in conjunction with Article 55, Paragraph (1) Number 1 of the Criminal Code, the judge added.
