Communication regulations’ substance unchanged in Job Creation Perppu

Communication and Informatics Ministry ensures the substance of the regulations governing the communications and informatics sector had not undergone significant changes in Regulations in lieu of Law (Perppu) No. 2 of 2022 on Job Creation.

“For the communication and informatics sector, in substance, nothing has changed in terms of regulations and only technical changes in writing, such as typos and capitalization,” Head of Legal Bureau of the ministry Bertiana Sari noted during the web seminar titled “Socialization of Perppu No. 2 of 2022 on Job Creation in Communication and Informatics Sector” on Tuesday.

Bertiana remarked that the communication and informatics sector is regulated in paragraph 15 of the Perppu on Job Creation.

There are three articles in the Perppu that regulated the communication and informatics sector, with the first being article 70 regarding postal and regulates the changes of Law No. 38 of 2009 on Post.

The second is article 71 that regulates telecommunication and changes in Law No. 36 of 1999 on Telecommunications.

Lastly, article 72 regarding broadcasting regulates changes in Law No. 32 of 2022 on Broadcasting.

In general, postal and telecommunication still have the same substance, but there is a slight change of mandate in the Perppu on Job Creation for the broadcasting field.

Broadcasting Director of the ministry Geryantika Kurnia stated that in the Perppu on Job Creation, specifically in the broadcasting sector, there are changes in relation to the timing of migration of analog TV to digital TV broadcasts.

“Previously, in the Law on Job Creation, the migration from analog TV to digital TV was valid for two years since the law was ratified. However, it was not written like that in the Perppu on Job Creation, but instead, it is written as 2 November 2022,” Gery pointed out.

The ministry emphasizes that the dissemination of information for the regulation of the communication and informatics sector contained in the Perppu on Job Creation is carried out in accordance with the requirements of establishing statutory regulations.

Despite no change in the substance, the public has the right to be informed and be re-educated that the Perppu will become the permanent regulation.

“This dissemination of information will not only be carried out once, but there will also be more information provided until it is officially ratified,” Bertiana stated.
