Constitutional Court Rejects Requests in Paethongtarn Case Over Inconsistencies

Bangkok: The Constitutional Court has dismissed three requests to revoke proceedings in the case concerning Paethongtarn’s ministerial status, citing factual inconsistencies. The court highlighted a key discrepancy regarding the royal decree that appointed Sarawut as a Constitutional Court judge on August 30, rather than August 29, which was a pivotal date in the case decision.

According to Thai News Agency, the petitions were filed by Mr. Niyom Nopparat, Ms. Paetongtarn Shinawatra, and the Speaker of the House of Representatives. They were submitted by Mr. Wisut Chainarun along with a group of 20 individuals. The petition aimed to overturn the proceedings in line with Ruling No. 17/2568, which resulted in the termination of Ms. Paetongtarn Shinawatra’s ministerial status due to an audio clip of her conversation with Samdech Hun Sen. The court further mandated a new trial since Mr. Sarawut Songsivilai was appointed as a Constitutional Court judge on August 29, 2025, replacing Mr. Panya Udchachon, rendering the original ruling by an unlawful panel.

The Constitutional Court reviewed all three petitions and noted that on September 3, 2025, it received a letter from the Office of the Senate Secretariat, numbered Sor. 0008/4304, dated September 1, 2025. This letter confirmed that a royal command had been issued appointing Mr. Sarawut Songsiwilai as a judge, effective from August 30, 2025, not August 29, 2025, as claimed in the petition. The inconsistency between the petition and the actual dates led the court to dismiss the petitions from consideration.
