Parties discontent with Health Law can seek judicial review: Mahfud

Makassar, South Sulawesi (ANTARA) – Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD called on parties dissatisfied with the omnibus Health Law to seek a judicial review from the Constitutional Court.The Health Law was passed by the House of Representatives (DPR RI) at the plenary session on Tuesday (July 11). “Because (the legislative process) has concluded, (the law) is now in force. If any party believed the law should be changed, we have the Constitutional Court; seek redress there and explain your reasoning to the court,” Mahfud stated here on Thursday (July 13). He noted that every law will have its proponents and opponents. They can seek a judicial review from the Constitutional Court if they are unsatisfied with the prevailing law. “Not only the Health Law, any law will have its proponents and opponents. It is a certainty,” the coordinating minister stressed. If the legislative process is concluded and the law is passed, it should be enforced, he remarked while adding that every resident should adhere to the prevailing constitutional system. “If any party is discontented and wants the Health Law overturned, our Constitution provides a judicial review avenue to the Constitutional court,” Mahfud remarked. The Indonesian Medical Association Executive Board (PB-IDI) and four professional associations earlier declared that they would seek a judicial review of the Health Law to the Constitutional Court. “We, the IDI and four other professional associations, will prepare legal measures as law-abiding residents by seeking judicial review (of the law),” PB-IDI Chairperson Adib Khumaidi noted, as per the statement on Wednesday (July 12). Khumaidi said the Health Law is flawed, as it was drafted in a haste without transparency and regard to inputs from all interested groups, including the health professional association.
