Bangkok: The legal team representing former Prime Minister Paethongtarn Shinawatra has officially filed a motion to revoke the impeachment process concerning a Constitutional Court judge’s term expiration. This legal action challenges the legitimacy of the removal process of a judge who continued to serve after his term had concluded.
According to Thai News Agency, the petition, submitted to the Constitutional Court, targets the improper continuation of Mr. Panya Udchachan in judicial duties. Despite the appointment of Mr. Sarawut Songwilai as his successor on August 29, 2025, Mr. Udchachan participated in a deliberation meeting and issued a ruling in Case No. 18/2568 on the same day, raising concerns about the legality of the decision.
The petition seeks to annul the unlawful trial process to ensure the proceedings are conducted lawfully. This follows a precedent where the Constitutional Court previously revoked a trial process after the Royal Command appointed Mr. Nakarin Mektrairat as President of the Constitutional Court and Mr. Sumet Roykulcharoen as a judge in March 2024, leading to a reevaluation and new trial.
The legal team argues that there are sufficient grounds for their petition and has referenced past Constitutional Court precedents to strengthen their case in ensuring constitutional compliance for Ms. Paethongtarn Shinawatra’s situation.
