Bangkok: 20 Pheu Thai MPs have submitted their names to the Constitutional Court regarding the judges whose terms have expired but are still performing their duties. Reporters reported that 20 Pheu Thai Party MPs, led by Mr. Wisut Chainarun, a party-list MP and chief government whip, have written to the Speaker of the House of Representatives, requesting that the petition be forwarded to the Constitutional Court for consideration of the legality of the adjudication process, Case No. 17/2568, in which the Constitutional Court voted 6 to 3 to rule that Ms. Paethongtarn Shinawatra has ceased her position as Prime Minister.
According to Thai News Agency, on August 29, 2025, the date of the Constitutional Court’s ruling, a royal decree was issued appointing Mr. Sarawut Songsivilai to the position of Constitutional Court judge, effective August 29, 2025, to replace Mr. Panya Udchachan, a Constitutional Court judge who had resigned due to the expiration of his term. Therefore, upon learning of the royal decree appointing Mr. Sarawut to replace Mr. Panya, who had already resigned due to the expiration of his term, Mr. Panya, a Constitutional Court judge whose term had expired, should not be allowed to consider such a significant case.
The 20 Pheu Thai MPs who submitted their names to the Speaker of the House of Representatives include Mr. Wisut Chairun, Mr. Cherdchai Tantisiri, Mr. Thirachai Saenkaew, Mr. Phumipat Phacharathap, Mr. Boonkaew Somwong, Mr. Chaiwatana Tinrat, Ms. Thiapchutha Khaokham, Mr. Khachit Chainikhom, Mr. Naphon Choeykhamhaeng, Mr. Songsak Songserm Udomchai, Dentist Sriyada Palimaphan, Mr. Aphichat Trisawadichai, Ms. Srisopa Kotkamlue, Mr. Thanet Khruerat, Ms. Kritsana Sihalak, Ms. Prapaporn Thongpaknam, Mr. Niphon Konkhayan, Mr. Chusak Maenthim, Mr. Watcharaphon Khaokham, and Ms. Piyarat Tiyapairat.
